Please read these Terms and Conditions carefully before using the services offered by Grab Haulier Sdn Bhd (“Grab Haulier” ) or (“We”, “Us”, or “Our”), a company incorporated under the laws of Malaysia. These terms set forth the legally binding terms and conditions for your use of Our Services as contained in https://grabhaulier.com (“Website“) (collectively with the site, referred to as “Services“).
Users of the service are fully responsible for any and all amendments and / or cancellations made via our Grab Haulier Portal. All changes, amendments and cancellations made by either party are subject to acceptance by the other Party. Grab Haulier does not guarantee that the amendments, changes and cancellations can be accepted by either party and will not be liable for any subsequent claims or damages that can possibly arise from the said amendments, changes or cancellations.
Once a delivery request (e-Booking) is submitted to us and payment is made for the said delivery request, Carriers/Hauliers who have accepted the e-booking will proceed as per instruction set out in the E-ROT forms. Any amendments or cancellations to your e-Bookings and/or e- ROTs with us are to be made via our Grab Haulier Web portal.
We provide a ‘service’ and hence, there is no ‘returns’ to be considered. We will take all reasonable care to ‘post’ and ‘re-post’ all requests and its subsequent amendments (if any) to the pool of Users but we do not guarantee or warranty that the new and/or amended requests will accepted by the Users. It is to be noted that time is of essence and that the Users making the request and its subsequent change, amendment and cancellation is fully responsible for his/her/their action and no claims can be made to Grab Haulier or its officers or its agents or its employees.
We will will endeavor to process all refunds and claims within a period of thirty (30) days however such claims are subjected to the insurance provider process.
Only Shippers and their nominees can make amendments to their Request for Shipment. Each Job (e-Booking and / or E-ROT) can only be amended 3 times.
Amendments / Changes can only be made up to 1 day prior to original shipment date and time.
Grab Haulier does not guarantee or warranty that Amendments/Changes submitted will be accepted by any Carriers/Hauliers in a timely manner. Time is of essence and Grab Haulier and the Carriers/Hauliers will not be responsible for any claims, damages that may arise from such Amendments/Changes made by you, the Shippers.
Shippers can cancel their E-Bookings and E-ROTS with us and all cancellations are to be made via our Grab Haulier Web Portal.
For e-Bookings (i.e. Requests which are yet to be confirmed by any Carriers/Hauliers), cancellations are allowed and entitled for 100% full invoiced value refund excluding the amount of the service fee. You will be informed when refunds can be effected.
For E-ROTS issued (i.e. Requests which have been confirmed by any Carriers/Hauliers), cancellations are allowed and only entitled for 90% of full invoiced value refund (excluding insurance charges and service fee) provided that the task is not yet started. In any case the task has been started, no refund is available.
5. NO WAIVER
The failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies.
6. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with Malaysian law and the parties irrevocably submit to the exclusive jurisdiction of the Malaysian courts.
7. SPECIAL TERMS
These Terms and Conditions are not intended to nor shall create any rights, entitlements, claims or benefits enforceable by any person that is not a party to them. No person shall derive any benefit or have any right, entitlement or claim in relation to this Terms and Conditions contained herein.
8. CHANGES TO THE TERMS AND CONDITIONS
We reserve the right to update this Policy at any time and any changes may be made without notice to you. We recommend you to read this Return, Refund and Cancellation Policy periodically. By continuing to access or use Our Services after those revisions or changes become effective, you agree to be bound by the revised terms. If you do not agree to the new Return, Refund and Cancellation Policy, please stop using the Website and/or Our Services. All of our rights are reserved.
